How Credit Counseling Works

Paul Rogers asked:

Credit counseling services are becoming a major industry in the world today, both for-profit and non-profit organizations are showing up more and more frequently, offering to help individuals who have had credit problems in the past to get out of debt and get their lives back on track.

Many people are skeptical of these services, afraid that they might simply be scams designed to prey on those who need financial help; while there are undoubtedly similar scams out there, many credit counseling services that you’ll find are actually legitimate and offer worthwhile services to those in need.

To avoid being taken advantage of you should investigate the service that you’re considering with your local consumer advocate group, and consider the following to make sure that credit counseling is right for you.

Debt Management

One of the major services that consumer credit counseling organizations provide is assistance with debt management. Working with the individual who needs help, the credit counseling organization examines their various debts and tries to help them find the best way to overcome their debts in the shortest amount of time.

Often they will be able to find options for individuals that the person might not have known existed… it’s not as easy as simply getting a loan, however, because the credit counseling service is trying to help the individual to eliminate their debt instead of simply shuffling it around.

They can assist the individuals with budgeting their income to help pay off their debts, and also are able to negotiate settlements with some creditors that greatly reduce the amount that the individual owes.

Budgeting

Since credit counseling services are attempting to help people to help themselves, a major part of the services that they provide deals with helping people to use what they have to help them get out of debt. Working with the individual, a credit counselor can develop a budget plan that the person seeking the assistance might not have been able to come up with on their own.

These budgets are often a bit tighter than some household budgets, since they’re designed with a focus towards eliminating the debts that have been hanging around for a while.

Depending upon the severity of the debt, the credit counseling service might also suggest more extreme measures like selling a car in order to purchase a more fuel-efficient model for less money and using the difference to pay off some of the debts. In most cases, however, actions along those lines are unnecessary and a basic budget is all that’s needed.

Creditor Negotiations

In addition to assistance in creating a solid budget, credit counseling services also work with an individuals creditors so as to reduce the total debt that the individual owes. Credit counseling agencies are often able to work out a settlement with the creditor so that in exchange for greatly reducing the amount of the debt the individual will work toward paying it off within a specific period of time.

While the amount may be similar to that which would be settled for in a lawsuit, the use of a credit counseling service to make the negotiation saves both time and legal fees and serves to stop the damage to your credit score sooner.

The amount of the reduction can vary depending upon the amount owed and the creditor that it is owed to, but at times these negotiations can reduce the debt by 50%, 75%, or more.

Consumer Credit Counseling Industry Grows

Leroy C. Calstard asked:

The emergence on consumer credit counseling over the past few decades is mainly due to the increasing number of Americans who continue to charge their way into unmanageable debt. This is not to say that there aren’t some families and individuals who have ended up in debt due to no fault of their own – whether it is due to high medical bills, illness, death or a change in family status. But most end up in debt because of charging too much on credit cards and store cards and buying things on credit that they wouldn’t otherwise be able to afford. At some point you just can’t keep up with even the minimum monthly payments, which in turn causes a huge amount of the debt to be just the interest owed.

For many individuals and families who find themselves in over their heads, bankruptcy can seem like the only answer. As a result of this consumer credit counseling organizations have emerged to try to deal with this growing problem by helping people manage their debts and make arrangements to get them out of debt. This is often the last step before bankruptcy.

In fact, recent bankruptcy laws have been introduced that require individuals to obtain consumer credit counseling before filing for bankruptcy in an effort to reduce the high cost of lawyers and court fees. Consumer Credit counseling is usually the best option because it allows to you manage and clear your debt without the negative impact of a bankruptcy on your credit report. Bankruptcies can stay on your credit file for up to 10 years and can seriously hinder your ability to obtain any type of credit or loan, and will bring down your credit score which can make it difficult for you to do anything from renting a house to getting a job that requires a security clearance. It can even affect your ability to open a bank account with an overdraft feature.

However, consumer credit counseling is not provided free of charge and not everyone can afford to obtain these services. Some are so deeply in debt that they can’t even afford help to get out of debt. But if you can go this route, you can get relief. Consumer credit counseling agencies can help you by getting your monthly payments reduced, getting interest rages reduced, getting over-limit charges and late charges waived and can help you consolidate all your payments into one payment to them. This will enable you to eliminate your debt entirely and clear your name, as well as rebuild your credit.

The Danger of Consumer Credit Counseling

Ted Batron asked:

One topic that I sometimes cover generates more hate male than any other. And I’m glad they hate me for it. It means I’m touching a nerve. The subject is the Credit Counseling or Debt Management companies that make the claim that they are non profit, or operating in the consumers interest.

Many of these companies charge up to 20% of the debt as a fee. That means that a consumer with $20,000 in credit card debt (not at all uncommon), would be charged up to 4000.00 – are you kidding me!

No wonder these companies spend so much on advertising. They can afford it. However, the tide is changing.

The IRS has begun revoking the tax free/non-profit status of many of these companies because they didn’t do what they said they were going to do, PROVIDE COUNSELING. Most companies that have debts owed to them will accept a reduced amount in order to get paid.

If you are behind in your debts and were to call your creditors now, explain your situation to them, and ask for a reduction in the balance vs. bankruptcy – most will accept immediately. So why should you pay an exorbitant fee just to get someone to make a phone call for you?

Proper negotiation requires knowledge of the law, what your rights are, forms and some instruction. It would be even better if these companies offered some assistance in the form of advice. But most don’t! No advice, no counseling, no education.

A few years ago the IRS begin investigating several of the largest credit counseling services, many with a non-profit status. The IRS commissioner, Mark Everson, stated that those agencies “poisoned an entire sector of the charitable community”.

The commissioner wet on to say that in many cases, all these agencies did was direct business to for-profit companies. Several of these agencies spent millions of dollars on ads to convince anyone with debt to solve their financial problems with a phone call to them.

Unfortunately, the IRS investigations may also affect the clients of these companies. New bankruptcy laws require that consumers get professional debt counseling before they file. Since many of these companies are not considered to be professional debt education companies, they did not qualify under the new statutes. What a mess!

Since most CCC and Debt Consolidation companies say that they are non-profit, and the consumers that use them are under duress, the consumer usually goes in with their defenses down a little. Homeless shelters, and churches are non-profit, so it has to be a good thing, right?

Most of these companies are for profit. The exist to make money off of people who are desperate to solve their debt problems, desperate to save their homes, their cars, their credit, their financial future, their families. The prey on fear, and do little to solve the problem.

Some companies out there do have your best interest at heart. Don’t work with the first one you see just because they claim to be non-profit.

The best way that you can solve the problem, is to learn how to negotiate with creditors. Educate yourself. You have rights, find out what they are! Find a company that will provide that education, and will answer questions and offer guidance when you need it.

That is the solution to permanent debt reduction, debt control, and debt elimination.

Consumer Credit Counseling – Does it Work?

Natalia Kobseva asked:

Consumer credit counseling: let us discuss these debt relief programs and also discuss on whether or not they or do not work; whether or not they are or are not effective; and whether or not there are suitable alternatives to consumer credit counseling.

First and foremost, this type of program is more than the name implies. It is foolish and foolhardy to accept this is only a matter of “counseling”. Because this is not so. Not so at all. For if we can expect this to only be counseling, then I, my friend have a quite nice bridge in the city of Brooklyn that is for sale on eBay. Do you understand this metaphor?

For with consumer credit counseling, these people take action. They make plans. They examine. They make a formula and strategy for the people in debt to become debt free. And isn’t this really more than simply to counsel? I say a mighty and emphatic “Yes we can!”

If one finds themselves behind the 9 ball when it comes to owing money to banks and credit card companies, in debt we shall say, then one is truly sorrowful. But if one can resurrect one’s finances and pull one’s self out of the valley of debt despair, then one has truly achieved something magnificent and worth crowing about. And this is a feather in our hat and our robe.

So let us consider debt consolidation. The consolidating of debts is quite useful for the purpose of paying off debt and becoming a slave no longer to debt.

Is Hiring A CCC (Consumer Credit Counseling) Agency Really Necessary?

Steven Douglas asked:

With all of the hype about the financial industry being to a negative effect, it is difficult to decide on the safest firm to hire. As a result of the natural level of uncertainty in this matter I have contrived a list of the pros and cons of going with CCC (consumer credit counseling).

Cons:

o You are paying a company to help you pay debts you cannot pay. As ironic as that sounds, it is exactly what you are doing.

Pros:

o By opting to hire a CCC firm, you are choosing to utilize the expertise of qualified credit repair professionals. This obviously gives you a better grip.

o A firm for hire usually has connections from within that allow them to negotiate credit balances, debts owed, and payment structures. This is not something you would be able to on your own.

o When you hire a company to do the dirty work for you, 95% of your stress is relieved. This is not to say that ALL of your life stresses will be transformed into a mental paradise as a direct result of hiring a CCC Agency; however, it is to say that you will be relieved of the burden of handling the minuet details and strenuous processes that are involved in the negotiation processes.

Now, this is by no means a complete list of the advantages and disadvantages. However, it is a realistic and comprehensive dissection of the major ups and downs.

If you have read this you are now better armed with factual pieces of information that should sway your credit repair plan. If you are still unsure about which way to go in regards to your decision, please further your research. This specific article is not the alpha and the omega. You can find an abundant amount of information online. Do your research!

And remember, it is your financial life. If you don’t fix it, who will?

Consumer Credit Help – Find Help With a Credit Counseling Service

Frank L Froggatt asked:

In today’s society, having and maintaining a good credit rating is exceedingly important if you want to live a comfortable and financially stress-free life. A good score is necessary for those who want to get financing for a car or a new home or any other big-ticket item people commonly get loans for.

A high credit rating has even become a determining factor in one’s eligibility for employment and housing these days. So having and maintaining good credit is more important than ever before.

For those with a low score, life can be rough and restrictive. So many doors are closed to these people, making credit repair almost a necessary requirement for anyone desiring even the basics, (such as jobs or apartments) in life.

In order to improve and repair a bad credit score, you’ll first need to educate yourself. Understanding what credit really is and how it is used is important if you want to improve your standing, credit wise. It also will help prevent you from making all the same mistakes again which ruined your standing to start with. So begin any credit repair plan with knowledge and information to minimize confusion later on after you put your plan into action.

Next, you need to know where you stand. You can obtain a one free credit report from each of the three main credit reporting agencies each year (Experian, Trans Union and Experian). This will show you exactly what your score is and should help determine what you need to work on.

Paying off old outstanding debt is priority number one toward improving your credit rating. That will keep those creditors from continuing to post negative reports to the reporting agencies. If you cut off the sources of bad reports, you’ll have begun the process of improving your score.

Bear in mind, paying off all those old debts will not instantly provide you with a good credit rating. It simply keeps it from getting worse, which provides you the opportunity to begin the improvement process.

A good credit counselor can help educate you about your finances and can help you tailor a plan to meet your needs. They also provide information and examples to help you start getting positive reports on your credit history-which is exactly what it takes to see improvement. Please note that any credit repair strategy will take time and effort-there is no instant fix for this situation-and often it will require some lifestyle and spending changes.
